1. scope of application

These terms of use govern the use of the parking areas and sanitary facilities of the Dasing Mobility Centre, An der Brandleiten 4, 86453 Dasing. The operator of the centre is Hörmann-Reisen GmbH, Fuggerstraße 16, 86150 Augsburg.

2. validity of the road traffic regulations

The current version of the German Road Traffic Regulations (StVO) applies throughout the site.

3. access and parking authorisation

  • Access is exclusively via the barrier system.
  • Use is only permitted if a parking ticket has been purchased or a valid advance booking has been made via an authorised booking app.
  • Exit is only possible if the parking fees due have been duly paid.
  • The operator is entitled to have unauthorised parked vehicles removed at the owner's expense and risk.

4 Fees and method of payment

  • The tariffs shown on the entry and ticket machines and in the booking apps apply.
  • The car park charges are before exit at the ticket machine or via the booking app.
  • When booking in advance via an app, the vehicle must be clearly identifiable (e.g. by licence plate recognition). In this case, the barrier opens automatically.
  • If the licence plate number is not technically recognisable (e.g. due to dirt or snow), the driver is obliged to take a parking ticket and enter his licence plate number at the pay station. Once the licence plate number has been successfully entered, the driver will be allowed to leave the car park free of charge in accordance with the valid advance booking.
  • Unpaid fees can be charged subsequently and legally enforced.

5 Video surveillance and data protection

  • The site is monitored by video cameras for security reasons, access control and to enforce domiciliary rights.
  • Responsible within the meaning of the GDPR is Hörmann-Reisen GmbH, Fuggerstraße 16, 86150 Augsburg.
  • The legal basis for processing is Art. 6 para. 1 lit. f GDPR (legitimate interest).
  • Recordings are used exclusively for the stated purposes and deleted after the statutory periods have expired.
  • Data subjects have the right of access, rectification, erasure, restriction of processing and the right to lodge a complaint with the competent data protection supervisory authority.

6 Obligations of the users

  • Vehicles must be properly parked within the designated areas.
  • Unnecessary running of the engine is prohibited.
  • Any rubbish accumulated during your stay may only be disposed of in normal household quantities in the rubbish bins provided.

7. use of WC and shower facilities

  • The existing toilet and shower facilities are only available to users of the car park.
  • Use may be subject to a charge; the tariffs displayed on site apply.
  • Users are obliged to treat the facilities cleanly and with care.
  • The operator accepts no liability for items left behind or damage caused by improper use.
  • The operator reserves the right to temporarily close the facilities for operational reasons (e.g. cleaning, maintenance, vandalism).
  • Misuse or gross soiling can lead to permanent exclusion from use and possibly to claims for damages.

8. liability

  • Use of the car parks and sanitary facilities is at your own risk.
  • The operator accepts no liability for damage, loss or theft of vehicles, their contents or personal belongings.
  • Liability claims can only be made in the event of intent or gross negligence on the part of the operator or its vicarious agents.

9. domiciliary rights

  • The operator exercises domiciliary rights.
  • Violations of these GTC or the StVO may result in a ban from the premises, contractual penalties or the removal of the vehicle.

10. final provisions

  • Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
  • The law of the Federal Republic of Germany shall apply.
